Petition to have Eternity eau de parfum declared misbranded

Dear Sir or Madam:

I am writing in support of the petition submitted last month by the Environmental Health Network (EHN) to have Calvin Klein's Eternity eau de parfum declared misbranded. I hope that the FDA will approve this petition in light of regulations 21CFR Sec. 740.1, 21CFR sec. 740.2, and 21CFR Sec. 740.10. Regulation 21CFR Sec. 740.10 states:

    Each ingredient used in a cosmetic product and each finished cosmetic product shall be adequately substantiated for safety prior to marketing. Any such ingredient or product whose safety is not adequately substantiated prior to marketing is misbranded unless it contains the following conspicuous statement on the principal display panel:

    "Warning - The safety of this product has not been determined."

Eternity contains ingredients shown to be toxic. However, no one has conducted the necessary tests or labeled this product in compliance with the aforementioned law. I request that you hold Calvin Klein accountable for complying with the law as written. Many people enjoy perfume but have no idea to what they are exposing themselves and others. All citizens have the right to make informed decisions about the products they buy and with which they come into contact. This is the point of labeling laws. Perfume manufacturers should not be allowed exception to the law under the guide of "trade secrets."

Personally speaking, I have landed in the emergency room of two local hospitals over a dozen times over the past five years, due to such exposures. Chemicals in perfumes worn by coworkers caused serious, life-threatening asthma attacks for me. I do not look forward to such incidents in ambulances and hospitals. Only you can prevent such events happening to me and the millions of asthma sufferers in the US, the number of which rises 40% per decade. Perfumes DO contain respiratory irritants. Scientifically, this fact already has been proven. Now, it is in your hands to do the right thing.
